Dealing with opposed modification or public path orders can be a resource-hungry process. Setting up from the first report on the application eases the whole process considerably. This course covers the process from objection received to preparation for an Inquiry, Hearing or Written Representations including submission to PINS, writing a Statement of Case and Proof of Evidence.
Main topics
- Drawing the line on withdrawal of objections
- Planning and preparation for submission to PINS
- Writing a Statement of Grounds, Statement of Case, and Proof of Evidence
- Managing evidence bundles
Learning outcomes
- Understanding of the process of an opposed order and its timeline
- Recognition of resources needed and how to reduce demand
- Familiarity with the documents required, their structure, strengths and weaknesses
- Appreciation of how to write documents for submission
Dealing with objections
The course covers the process and time-saving in referral of an order to the Planning Inspectorate once objections have been received.
It does not consider in depth the variety of objections which may be received or the skills to encourage withdrawal of an objection as the former is more simple than it may appear and the latter is beyond the range of an IPROW course since it would require role play, coaching and practice over a period with different people, themselves knowledgeable in providing the appropriate responses for the trainee to learn from.
A paper is issued summarising types of objections and how they may be tackled but course time focuses on recognising the point at which the order should simply be abandoned or referred.
Preparation Time Required
The course will close at 1p.m on day 1 but there will be a task to complete before day 2 so participants are strongly recommended to allocate all of day 1 to the course.
Level
Intermediate. The course is designed for council officers with knowledge of the order process, perhaps approaching submission of their first opposed order.
