Public Path Orders from enquiry to decision

-
9.30 to 13.00

Virtual by Microsoft Teams

First knowledge of a wish to change a right of way may be a conversation between you and an interested party or between them and a colleague, or it may be receipt of an application. It is important for all involved to avoid misunderstanding with the interested parties, and to ensure that all the information required to make a decision and draft an order (if the decision is yes) is provided.

With the potential for increased applications in future from Right to Apply, having a protocol in place for efficient and equitable processing will be helpful.

Note that the course stops with the decision to make an order (or not). Drafting the order and dealing with objections are dealt with in other courses.

Main topics

  • Practical considerations on site and with the applicant
  • Meeting the tests from the start
  • Convenience, width, surface, structures relative to status
  • Information from site to the Order-making officer
  • Potential objections and mitigation

Learning outcomes

  • Understanding the tests for making an order, that it's rarely as easy as an applicant may think, and why
  • Awareness of 'ticking all the boxes' in succession to save resources
  • Awareness of the benefits of policy and guidance on physical attributes from width to structures
  • Understanding why detail and accuracy are important to ensure all relevant information is provided to the order-making officer

Level

Designed for any officer likely to answer a query from an interested party about changing a public right of way, whether diversion, creation or extinguishment, as well as officers who would receive an application and proceed to a decision whether to make an order or not.
