Having assessed an application and decided to make an order, what next? This course covers the detail of drafting an order and associated notices, statutory consultation, advertising and orders on deposit. It focuses on accurate drafting to avoid technical failures and inadequate orders and considers options for common difficulties such as parish boundaries along the route, varying widths and limitations.
Note that the decision process to make an order is not covered as it is dependent on individual councils’ policies. Dealing with objections is covered in the course Opposed Orders.
The course includes 'homework' on the first afternoon, so you are recommended to allocate all of the day to the course.
Main topics
- Complying with regulations to avoid technical objections
- Combined orders or not – what to consider
- Compiling an order plan to avoid objections based on “It’s unclear”
- Drafting an order and notice using templates
- Differences between orders made under Highways Act 1980 and Town and Country Planning Act 1990
- Advertising, consultation, covering letters and deposit
Learning outcomes
- Understanding of the legislative framework
- Awareness of the need for accuracy and compliance with regulations
- Understanding of using templates and what data is required to complete them
