User Evidence
Event Over
If you are interested in a repeat of this event, contact training@iprow.co.uk

User evidence is included in the majority of applications for Definitive Map Modification Orders and requires some skill to both manage it, especially in cases with a lot of evidence, and evaluate it. Unconscious bias can ruin a case, as can failure to check validity and truth of witness statements. While resources may be too tight to check every user evidence form submitted, there are some checks which must be made.
Main topics
- The legal tests and case law behind the data required
- User evidence form design, GDPR and disclosure
- Evaluating and managing the data received
- Conducting interviews
- What to look for in witnesses to give evidence at Inquiry
Learning Outcomes
- Clear understanding of decisions and application of the legal tests
- Appreciation of the fallibility of memory and how to improve recall
- Awareness of the limitations and strengths of witness evidence
- Appreciation of the need to test evidence
Level
Intermediate: for delegates with some prior knowledge of the subject.
The course is designed for Rights of Way Officers; legal officers or solicitors, especially acting as advocate in rights of way cases.
