Deregulation Act 2015 (modification orders)
The parts of the Deregulation Act 2015 which affect public rights of way have not yet been commenced; they need secondary legislation which is still in preparation. Without those regulations, there are still a great many questions about the effect of the Act on practioners. However, there are a number of matters which can at least be considered and preparation made for the most likely outcomes so that an authority is in a better position when the regulations do appear.
Rosalinde Emrys-Roberts is part of the Stakeholder Working Group, which contributed a lot of work towards the Deregulation Act and remains engaged in the process to produce secondary legislation. Ros also led some of IPROW’s first series of workshops to help prepare authorities in 2016. This webinar is a brief summary of the key issues and suggestions for what work can reasonably done to prepare in advance of regulations.
